1. This site and associated pages, domains, addresses, related sites, blogs, wikis, bug trackers, and apps (the "Site") are operated and developed by Craig A. Pearlman DBA Black Fog Games and Black Fog Interactive (the "Company"), a sole-proprietorship of the Commonwealth of Pennsylvania, USA.

Personal Information ("Personal Information") includes, but is not limited to, email addresses, phone numbers, names, titles, occupations, roles, social media aliases, Web site addresses, gender, gender identity, location, addresses, device identifiers, device information, and crash report data.

The Company does participate in third-party services such as Apple's App Store and TestFlight beta testing, Zendesk for support services, Crashlytics crash reporting, Slack discussion groups, MailChimp for email newsletters and promotions, and other services ("Third-Party Services") that may require the use and provision of Personal Information which may or may not be shared with the Company. All Third-Party Services are covered by the respective service agreements of those services.

    1. The Company is not in the business to collect or store Personal Information in any way. We take your privacy seriously. Site features or applications that do not adhere to this policy will clearly indicate and will always ask permission before accessing or requesting Personal Information. Personal Information collected as the result of normal business, implicit or explicit, such as the submission of a Site request form, are used for designated purposes only and are not centrally stored. Email communications with the Company (implicit or explicit), which may contain Personal Information, may be stored centrally in an electronic archive to facilitate customer service needs.

Data, files, workflows, attachments, texts, and posts shared with the Company ("Submissions") for the purposes of inclusion in online directories and/or the Site imply permission to use Personal Information contained therein within the reasonable scope and purpose of the Submission. The Company claims no IP ownership of such materials, however, by submitting, you give the Company exclusive and perpetual rights to use the material for its intended purpose (regardless of its governing license) including making the Submission (if appropriate) available for use by third-parties. The Company shall honor all take-down requests and notices from the submitter or other legally-entitled representatives. You must be the legal copyright holder of any Submissions. Where appropriate to the Submission, you may indicate a license to be associated to the Submission for inclusion on the Site and such license will be indicated as the governing license.

    4. The Company adheres to a strict no spam policy. Personal Information collected for newsletters, product updates, or other promotions will always require opt-in (though the nature of providing Personal Information for promotional purposes opts-in implcitly) and the ability top opt-out (immediately, if possible) shall be made available, unambiguous, and easy to locate. This policy additionally extends to social media promotions.

    5. The Company may update or change these policies at any time. Significant and/or fundamental changes to these policies shall be communicated reasonably using appropriate communication channels. These policies may be superseded or overridden by valid warrants, subpoenae, or other legal action. Third-Party Services are governed by their respective policies.

    6. Except where other contracts, warranties, or guarantees supersede, the Company makes no guarantees, warranties, or claims of service or functionality.
